When you first open Movie Snob (the "App"), you are shown these Terms of Use and our Privacy Policy and asked to accept them. By tapping to accept, you agree to both. The Privacy Policy is part of this agreement. If you do not agree to both, do not use the App.
We keep a record of when you accepted and which version you accepted.
Movie Snob is a personal movie-tracking app for logging movies you have watched, rating them, building a watchlist, and getting recommendations based on your own taste. It is not affiliated with, endorsed by, or certified by any movie studio, streaming service, or movie database provider, including TMDB or JustWatch.
Movie Snob is provided by Maximus Development LLC, a Texas limited liability company, referred to in these terms as "we," "us," or "our."
Movie Snob is intended for people aged 13 and over. By accepting these terms you confirm that you are at least 13 and have the legal capacity to enter into this agreement. If you are between 13 and the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf. Movie Snob is not directed at children under 13 — see Section 13.
Depending on where you live, your app store may be required to confirm your age category and, if you are under 18, to obtain the consent of a parent or guardian before you download the App, make a purchase, or accept a significant change to the App.
Where your app store provides us with your age category, we use it only to make sure the App behaves appropriately for your age. We do not receive, and do not want, the identity documents or verification method your app store used — only the age category itself.
If a parent or guardian withdraws consent for you to use Movie Snob, your app store notifies us and your access to the App will end. If you are a parent or guardian with questions about this, contact us at moviesnob@icloud.com.
Movie Snob does not operate a user-account system, and we do not keep a database of your movie logs, ratings, or watchlist on any server we control. That data lives on your device and, if you choose to sign in and turn on sync, in your own private iCloud account through Apple's CloudKit. We cannot see your iCloud data.
We do run one small server. It acts as a relay for movie-information requests, so that our access credentials for third-party movie data are not exposed inside the App itself. When your device looks up a movie, the relay receives that request and your device's IP address, passes the request along, and returns the result. It does not receive your name, your email, your Apple ID, or your movie logs, ratings, or watchlist. Our Privacy Policy, Section 4, explains what the relay logs and for how long.
You are responsible for keeping your device, Apple ID, and iCloud account secure, and for what happens if you do not. We are not responsible for data loss caused by your device, your iCloud storage limits, Apple's services, or other factors outside our control.
You agree not to use Movie Snob to: violate any law or regulation; infringe anyone's intellectual property, privacy, or other rights; harass, abuse, or harm another person; upload, post, or transmit anything unlawful, defamatory, obscene, or infringing; interfere with, disrupt, reverse-engineer, decompile, scrape, or attempt to gain unauthorized access to the App, our relay server, or the third-party services the App connects to; or interact with in-app advertisements in a fraudulent, automated, or otherwise abusive way, including click fraud or artificially inflating ad impressions.
We may end your license to use the App, and block access to our relay server, if you violate this section.
Movie Snob lets you write notes and reviews about movies. What you write stays on your device and, if sync is on, in your own private iCloud account. It is never published to other users, and we cannot see it. You keep all rights to what you write.
Because nothing you write is shared or displayed publicly, we do not moderate it and we have no ability to remove it. You are responsible for what you write, and you can delete it at any time from within the App.
Movie data — posters, cast, runtime, synopsis — is provided by The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB. Streaming availability, where shown, is provided by JustWatch through the TMDB API.
These services have their own terms, their own availability, and their own accuracy. We do not control them and we are not responsible for their accuracy, completeness, or uptime. If a third-party data provider changes or ends our access, features of the App that depend on it may change or stop working.
Recommendations generated by the App are based on your own input and are provided for entertainment only. We do not guarantee you will like anything the App suggests, and recommendations are not professional advice of any kind.
Movie Snob is supported in part by advertising. We use Google AdMob to show native, in-list ads. Every ad request the App makes is configured as non-personalized: we do not request or use Apple's advertising identifier (IDFA), and the App does not show an App Tracking Transparency prompt, because it does not do IDFA-based ad tracking.
Google may still process limited technical information — such as device type, IP address and the general location it implies, and coarse ad-interaction data — in order to serve and measure non-personalized ads, prevent fraud, and support Apple's SKAdNetwork install-attribution system. Google acts as an independent data controller for that processing and its own privacy policy applies to it. See our Privacy Policy, Section 6.
Ads are supplied by third parties. We do not control, endorse, or take responsibility for the content of any advertisement or for the products and services advertised. Ad availability may vary or be absent depending on your region, App configuration, or Apple and Google policy.
Movie Snob is currently free, and every feature is available at no cost. There is no subscription to purchase today.
We may introduce an optional Premium subscription in the future. If we do: subscriptions will be billed through your Apple ID account; they will auto-renew unless cancelled at least 24 hours before the end of the current period; and you can manage or cancel them in your iOS Settings. Pricing and included features will be shown before purchase. Except where required by law or by Apple's policies, payments are non-refundable.
Which features are free and which are paid may change over time. We will give reasonable notice before making a material change that affects a feature you are already actively using, and introducing paid features may require your app store to seek fresh parental consent if you are under 18.
If you are using a TestFlight, beta, or other pre-release version of Movie Snob, you understand and agree that:
You may stop using Movie Snob at any time by deleting it from your device.
We may end the license granted by these terms, and may stop providing the relay service, updates, or support to you, if you violate these terms. Because Movie Snob stores your data on your own device and in your own iCloud account, we cannot delete your data and we do not control your copy of the App.
Sections that by their nature should survive termination — Sections 8, 13, 14, 15, 16, 17, 18, and 19 — will survive.
Movie Snob is not directed at children and is not intended for use by anyone under 13. If you are a parent or guardian and believe a child under 13 has used the App and provided personal information, contact us at moviesnob@icloud.com so we can address it.
MOVIE SNOB IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the App will be uninterrupted, secure, or error-free, or that recommendations, movie data, streaming availability, or advertising content from third parties will be accurate, complete, or available. Recommendations are for entertainment only and are not a substitute for your own judgment.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, arising from or related to your use of, or inability to use, the App, third-party data or services accessed through it, or any advertisement shown in it — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability to you for any claim arising from these terms or the App is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $50.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of Sections 14 and 15 may not apply to you, and you may have additional rights that vary by where you live.
You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your use of the App, your interaction with any third-party service or advertisement accessed through it, your violation of these terms, or your violation of the rights of a third party.
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. This choice of law does not deprive you of the protection of any mandatory consumer-protection rules of the place where you live that cannot be varied by agreement.
Talk to us first. If you have a problem, email moviesnob@icloud.com describing it and what you would like us to do. Most things can be sorted out this way, and we would rather solve it than argue about it.
Where disputes are heard. If a dispute cannot be resolved informally, you and we agree that it will be brought exclusively in the state or federal courts located in Collin County, Texas, and you and we each consent to personal jurisdiction there. Either of us may still bring an individual claim in small claims court if it qualifies.
Class-action and jury waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable as to a particular dispute, it does not affect the rest of this section.
Acknowledgement. If you downloaded Movie Snob from the Apple App Store, you acknowledge that these terms are between you and us only, not Apple, and that we, not Apple, are solely responsible for the App and its content.
Scope of license. Subject to these terms, you are granted a limited, non-exclusive, non-transferable license to use Movie Snob on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Movie Snob may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
Maintenance and support. We are solely responsible for any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
Warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility.
Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar legislation.
Intellectual property. If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party terms. You must comply with any applicable third-party terms when using the App — for example, your wireless carrier's data agreement.
Apple as third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance will have the right to enforce them against you.
Who we are and how to reach us. Movie Snob is provided by Maximus Development LLC, a Texas limited liability company located at 3701 Delta Drive, McKinney, TX 75071. Questions, complaints, or claims about the App should be directed to moviesnob@icloud.com or (210) 313-2155.
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these terms is not a waiver of our right to do so later. We may assign these terms in connection with a transfer of the App or our business; you may not assign your rights without our consent. We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App.
We may update these terms as the App changes. If a change is material, we will show you the updated terms in the App and ask you to accept them again before you continue. For minor changes, we will update the version and date at the top of this document.
